Nicholas Ivie is suspected of shooting first at fellow agents believing they were drug smugglers

Federal investigators say two groups of Border Agents were unknowingly near one another when Ivie opened fire.  He injured an agent who returned fire, killing Ivie.

The National Border Patrol Council is calling it an unfortunate incident.  The U-S Border Patrol says it is now reviewing its protocols to prevent similar situations from occurring.

Ivie's family is expected to comment on this latest finding.

A funeral service for the fallen Border Agent is being held Monday in Sierra Vista.
